These Terms of Service govern your use of LearnSmart and its related website, applications, APIs, and services.
By accessing or using LearnSmart, you agree to these Terms. If you do not agree, do not use the service.
The Service
LearnSmart provides AI-assisted tools for turning source material into structured learning assets. Features may include uploads, link processing, summaries, notes, flashcards, mind maps, podcast-style outputs, search, and contextual chat.
We may add, change, suspend, or remove features at any time.
Eligibility And Accounts
You are responsible for:
- providing accurate account information
- maintaining the security of your account
- all activity that occurs under your account
You may not use another person’s account without permission.
Acceptable Use
You agree not to use LearnSmart to:
- violate any applicable law or regulation
- infringe another party’s intellectual property, privacy, or other rights
- upload or submit content you do not have the right to use
- distribute malware, spam, or abusive content
- interfere with the service, infrastructure, or security systems
- attempt unauthorized access to accounts, data, or systems
- reverse engineer, scrape, or abuse the product beyond normal intended use
- use automated means to overload or disrupt the platform
We may suspend or terminate access if we believe your use creates legal, operational, or security risk.
User Content
You retain ownership of the content you upload or submit, subject to any rights needed for us to operate the service.
By using LearnSmart, you grant us a limited license to host, store, process, reproduce, and transform your content solely as needed to:
- provide the requested product features
- generate study outputs
- maintain and secure the service
- troubleshoot, prevent abuse, and improve reliability
You represent that you have the necessary rights to submit that content.
AI Outputs
LearnSmart uses AI systems to generate outputs from source material. These outputs may contain mistakes, omissions, or misleading statements.
You are responsible for reviewing and evaluating any generated output before relying on it for study, work, legal, medical, financial, or other high-impact decisions.
LearnSmart does not guarantee that AI outputs are correct, complete, or suitable for any particular purpose.
Availability And Processing Limits
Some features depend on third-party infrastructure, model providers, storage systems, and payment services. Because of that:
- uptime is not guaranteed
- processing speed may vary
- some jobs may fail, time out, or be rejected
- feature access may depend on plan limits, credits, or technical constraints
We may impose file, rate, storage, concurrency, or usage limits to protect the service.
Paid Plans And Billing
Some features may require payment, subscription, credits, or plan-based access.
If you purchase a paid plan:
- billing may be handled by Stripe or another authorized payment provider
- you agree to pay applicable fees, taxes, and charges
- subscriptions may renew automatically unless cancelled, if stated at purchase
- access to paid features may change if payment fails, a subscription expires, or credits are exhausted
Unless otherwise stated, fees are non-refundable except where required by law.
Intellectual Property
LearnSmart, including its software, design, branding, and non-user content, is owned by or licensed to us and protected by applicable intellectual property laws.
These Terms do not give you ownership of the service itself. You may use the service only as permitted by these Terms.
Third-Party Services
LearnSmart may rely on third-party providers, including authentication, storage, payment, analytics, hosting, and AI services. We are not responsible for outages, errors, or policy changes caused by third-party services.
Termination
You may stop using LearnSmart at any time.
We may suspend or terminate your access at any time if:
- you violate these Terms
- your use creates risk for the platform or other users
- required by law
- we discontinue part or all of the service
Termination does not remove obligations that reasonably should survive termination, including payment obligations, ownership provisions, disclaimers, and liability limitations.
Disclaimers
LearnSmart is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
Limitation Of Liability
To the maximum extent permitted by law, LearnSmart will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising out of or related to your use of the service.
If applicable law does not allow certain limitations, some of the above limitations may not apply to you.
Changes To These Terms
We may update these Terms from time to time. When we do, we will post the revised version here and update the date at the top of the page.
